PhySoft Privacy Policy

Physician Software Systems, LLC (“PhySoft,” “the company”) is committed to protecting personal information shared with PhySoft by individuals and entities that engage with the company’s website and/or sales and marketing representatives (“prospects,” “users,” “visitors”).

Scope

This Privacy Policy explains how PhySoft collects, uses, and protects information received via the following means:

  • Information submitted through PhySoft’s public website(s), including https://physoft.com
  • Information provided to PhySoft representatives at conferences, educational events, trade shows, and other in-person or virtual sales and marketing events

PhySoft’s website is not intended for use by children, and the company does not knowingly collect personal information from children under the age of 18.

PhySoft’s SaaS application(s) are subject to separate, dedicated, expanded privacy policies that define the privacy and data protection practices that govern client, clinic, and patient data in compliance with HIPAA and other applicable regulations. Such terms are outside of the scope of this policy.

1. Information collected

Voluntarily disclosed information

Users may voluntarily provide personal information when requesting additional information about PhySoft’s products and services, including the following:

  • Name
  • Email address
  • Phone number
  • Company name
  • Other information voluntarily disclosed

PhySoft does not collect payment information, such as credit card data, on its public website(s).

Non-personal information

For analytics and website optimization purposes, PhySoft may also collect non-personal information, such as browser type, referring site, and time and date of visit. This information cannot be used to identify individual site visitors.

PhySoft does not currently have a mechanism in place to respond to do-not-track (DNT) browser signals or other settings that automatically communicate a preference to opt out of such data collection.

2. Use of information

PhySoft processes user information only for legitimate business interests and compliance with legal obligations.

PhySoft uses the information prospects provide to perform the following tasks:

  • Respond to inquiries or requests
  • Provide information about PhySoft’s products and services
  • Improve PhySoft’s website and offerings

Recipients of marketing and promotional communications from PhySoft may opt out (unsubscribe) at any time.

3. Data sharing

PhySoft processes and shares user data only as follows:

  • By consent. PhySoft may process user data if given specific consent to use it for a specific purpose, such as marketing to users who opt in and contract fulfillment.
  • Legal obligations. PhySoft may disclose user information when legally required to do so in compliance with applicable law, governmental requests, judicial proceedings, court orders, and legal processes.
  • Vital interests. PhySoft may disclose user information where it is necessary to investigate, prevent, or take action regarding potential violations of PhySoft’s policies, suspected fraud, situations involving potential threats to any person’s safety, and illegal activities.
  • Business transfer. PhySoft may share or transfer user information in connection with, or during negotiations of, any merger, sale of company assets, or acquisition of all or a portion of the company’s business by another company.

PhySoft does not sell or rent personal information to third parties.

4. Storage duration

PhySoft keeps users’ personal information for only as long as it is necessary for the purposes outlined in this policy.

When PhySoft has no ongoing legitimate business need to process users’ personal information, the company either deletes or anonymizes such information. If this is not possible (for example, because information has been stored in backup archives), PhySoft securely stores the information and isolates it from any further processing until deletion is possible.

5. Data security

PhySoft implements reasonable and appropriate technical and organizational security measures to protect users’ personal information from unauthorized access, use, and disclosure. It is important to note, however, that no electronic transmission or information storage technology can be guaranteed to be 100% secure. PhySoft does its best to protect users’ personal information but cannot promise or guarantee that unauthorized third parties will never defeat the company’s security and improperly collect, access, steal, or modify such information.

6. User rights

PhySoft relies on user consent to process personal information. Users have the right to withhold consent by choosing not to submit forms on PhySoft’s website(s) or provide information to PhySoft’s representatives. Users also have the right to withdraw consent (opt out) at any time; this can be accomplished by following an unsubscribe link in an email or contacting PhySoft directly.

Withdrawal of consent does not negate the lawfulness of any processing that occurred prior to its withdrawal, nor does it affect the processing of personal information in cases involving legal obligations, vital interests, or business transfer.

In some regions, such as the state of California, the European Economic Area (EEA), the United Kingdom (UK), and Switzerland, users have rights that allow greater access to and control over personal information. For residents of such regions, PhySoft will consider and act upon requests in accordance with applicable data protection laws.

7. Third-party links

PhySoft’s website may contain links to third-party websites. PhySoft is not responsible for the privacy practices or the content of any website not expressly identified in this policy.

8. Policy changes

PhySoft may update this policy from time to time. Changes will be posted on this page with an updated effective date.
